Section of the NRA, recognizing an unreasonable practices defense to freight undercharge claims brought by carrier which is “no longer transporting property,” also applied in bankruptcy context to freight undercharge claims brought by bankrupt motor carrier; NRA provision was not conditioned on “insolvency” or “financial condition” of carrier asserting rate undercharge claims, within meaning of bankruptcy statute invalidating such provisions in applicable nonbankruptcy law, but only upon carrier’s “no longer transporting property.” North Penn Transfer, Inc. v. Stationers Distributing Co. , 174 B.R. 263 (N.D.Ill.1994).
