Subsections of the Negotiated Rates Act (NRA) applying only to motor carrier that is no longer transporting property or is transporting property for purpose of avoiding application of NRA are conditioned on “financial condition” of debtor carrier within meaning of antiforfeiture provisions of Bankruptcy Code, and thus are ineffective and unenforceable against bankruptcy trustee.
