Negotiated Rates Act provisions applicable only as against carriers no longer transporting products, including provision allowing settlement options for shippers who negotiated unfiled rate lower than filed rate claimed by trustee, and unreasonable practice provision allowing claim that carrier is committing unreasonable practice by attempting to collect higher filed rate after having negotiated and collected at lower rate, were not based on carrier’s financial condition and thus did not violate Bankruptcy Code antiforfeiture provisions when used as defense against claims asserted on behalf of bankrupt motor carrier.
