Even assuming that provision of Negotiated Rates Act (NRA) exempting small business concern’s from liability on freight undercharge claims applied only to freight undercharge claims brought by carriers who were “no longer transporting property,” requirement that carrier be “no longer transporting property” was not equivalent to “financial condition” requirement, within meaning of bankruptcy statute prohibiting termination of debtor’s interest in property based upon its “financial condition”; statute operated retroactively to deprive bankrupt carrier of its freight undercharge claim against small business concern based solely upon the fact that carrier had ceased operating, and not based on its financial condition. Matter of Best Refrigerated Exp., Inc., 168 B.R. 978 (Bkrtcy.D.Neb.1994).

Bankruptcy Code section providing that interest of debtor in property becomes estate property notwithstanding any provision in applicable nonbankruptcy law that is conditioned on insolvency or financial condition of debtor and that effects or gives option to effect forfeiture, modification, or termination of debtor’s interest in property did not conflict with Negotiated Rates Act (NRA), and, therefore, did not govern inquiry as to whether, in action brought by carrier, which was bankruptcy debtor-in-possession, against shipper to recover freight undercharges under “filed rate doctrine,” shipper could assert defenses that freight contracts were made pursuant to contract carriage, that attempts to collect freight constituted unreasonable practice, and that filed rates were unreasonable. Jones Truck Lines, Inc. v. Grinnell Corp. Anvil Products Div., 167 B.R. 488 (N.D.Ill.1994).
