Chapter 7 debtors, who had unsuccessfully argued in first proceeding that their 401K ERISA pension plans should be exempt from their bankruptcy estates, were precluded under doctrine of collateral estoppel from arguing in later proceeding that the plans were not property of the bankruptcy estates at all, even though in the interim the United States Supreme Court had decided that debtor’s interest in self-settled trust containing an ERISA antialienation provision is excluded from the bankruptcy estate. In re Miller, 153 B.R. 269 (Bkrtcy.D.Minn.1993).
