Bankruptcy statute providing that interest of debtor becomes property of the bankruptcy estate notwithstanding any provision in applicable nonbankruptcy law that is conditioned on the debtor’s insolvency or financial condition did not prevent application of the Negotiated Rates Act to Chapter 11 debtor carrier; the Act’s legislative history and plain language made it clear that Congress intended the Act to apply to bankrupt carriers, and the court could find no irreconcilable difference between the bankruptcy statute and the Act since it is not the carrier’s financial condition that triggers the termination of property interests, but, rather, the retroactive application of the Act that operates without regard to a carrier’s financial condition. North Penn Transfer, Inc. v. Victaulic Co. of America, (E.D.Pa.1994) 859 F.Supp. 154.
